TERMS AND CONDITIONS…PLEASE READ CAREFULLY BEFORE USING THE APP / STORE!

 

Use of Daily Simple Fit on a computer, mobile phone, tablet, console or other device, you agree that you have read and agree to Daily Simple Fit terms and conditions in their entirety. 

 

You agree to the terms and conditions for the summation of your time as a customer. “Customer” status is defined by; Any person who has paid for the services of Daily Simple Fit.

 

A user is no longer a customer when their respective access to the app expires, thus releasing them of their contractual obligations presented in the terms and conditions of Daily Simple Fit. 

 

Notice of Physical Exertion

 

This app sells and suggestions activity that might be dangerous and or hazardous to one’s health. Personal injury can occur when performing physical activity, the customer is 100% liable and responsible or any personal injury and or property damage that might occur. Agreeing to the terms and conditions waves all liabilities of Daily Simple Fit and places all the responsibility on the customer.

 

You should always consult your physician or other healthcare provider before changing your diet or starting an exercise program. I understand that there is a risk of injury associated with participating and using Daily Simple Fit.

I hereby assume full responsibility for any and all injuries, losses and damages that I incur while attending, exercising or participating in Daily Simple Fit. I hereby waive all claims against Daily Simple Fit, its instructors, or partners of individually or otherwise, for any and all injuries, claims or damages that I might incur.

 

Notice Intellectual Property

 

All intellectual property, defined as but not limited to; verbiage, pictures, videos, workouts, logos, icons, and clothing designs are the sole property of Daily Simple Fit. Copyright infringement will be prosecuted under the full extent of the law. All creations of Daily Simple Fit are owned and operated only by Daily Simple Fit employees. Use of any icons, decals, colors, and or logos will be prosecuted fully. 

 

Restrictions of App Content

 

The content presented on Daily Simple Fit is for personal use only. No reselling of the content under the same name, or a different name. The content cannot be recorded, reordered, resider or reused in any way. The sole purpose of the content is to be used by the customer in an educational way. No resale of Daily Simple Fit products or content will be permitted. Any actions committed outside of the previously described will be persecuted by the full extent of the law. 

 

Personal Information

 

In the app you will be asked to provide personal information. This information is stored and used only by Daily Simple Fit, for purposes of bringing you the best workout experience possible. Daily Simple Fit will not sell your information to another company. You will not be spammed by a 3rd party. Your personal information will be deleted, if requested, if a customer’s status expires.

 

Links

 

Any links found on the app from a third party service are the responsibility of the third party. Add’s and endorsements will be for sale on the platform, but the customer and the third party are responsible for the interaction that occurs on the third parties site. The customer is responsible if their activity deviates from Daily Simple Fit app and or website. 

 

Mobile Services

 

The app provides services that will be available on some mobile devices. Current data rates and charges do apply per your carrier. Daily Simple Fit will not be fiscally responsible for any fees or charges that your mobile carrier chooses to apply to your account per your personal data plan. Consult you mobile provider before downloading any application if you are unsure about your data plan capabilities. 

 

Indemnification Policy

 

You agree to indemnify, defend, and hold harmless Daily Simple Fit, all its employees and affiliates, from any loss of property damage, personal injury, and or financial loss. Daily Simple Fit is in no way responsible for anything other than improving your quality of life, mood, and interactions with your clinicians. 

 

Privacy Policies; 

 

User Interaction Disclaimer

 

Any interaction on Daily Simple Fit’s website, app, and or social medias is the responsibility of the user. It is the responsibility of the customer to behave in an manner that represents themselves, and Daily Simple Fit in a professional manner. No bullying, racist, sexist, and or offensive remarks will be tolerated towards Daily Simple Fit, it’s users, or any other online customer or entity. This is a place of positivity, and negativity will not be tolerated in any form!

 

Severability

 

If any provision in this document shall be deemed unlawful, the remaining provisions shall stand as enforceable as agreed upon in the user agreements. Any ruling on unlawfulness against one provision does not nullify any of provision. Each provision is it’s own entity and one does not add to or diminish another. 

 

Termination

 

Daily Simple Fit reserves the right to terminate, delete and or abolish any customers status, tenure-ship and or ability to use the app. The app is a privilege that can be taken away for actions defined earlier in this agreement. No trolling or any more negative comments will be allowed, this is a place to work and grow collectively, not gossip and shame others. Please enjoy our app and it’s users respectfully.
